We are committed to protecting the privacy of our clients and other persons we deal with.

Whose personal information we collect

We may collect and hold information including about (but not limited to):

  • clients, potential clients, business associates and their employees;
  • visitors to our website;
  • contractors;
  • job applicants;
  • suppliers and their employees; and
  • others we come into contact with

What personal information we collect

The information we collect and hold may include:

  • normal identification and contact details;
  • how clients were referred to us;
  • occupation of clients and the industry they work in;
  • information including financial information collected from you during the course of acting for or dealing with you or in negotiating the terms of our business relationship with you.

If you do not provide the information that we request, we may not be able to act or continue to act for you or to continue our business relationship.

How we collect personal information

Information may be collected from you either directly, from third parties or electronically.  Access to our website is governed by separate terms and conditions (please see below).  The website terms and conditions is subject to and forms part of this Privacy Policy.

Use and disclosure of your personal information

Information may be used by us in:-

  • determining the basis of our relationship with you including undertaking credit checks;
  • providing the services that you have requested from us or in receiving services from you;
  • administering and managing those services;
  • enabling our related entities to assist you with related services as required;
  • researching, developing and enhancing our services;
  • marketing our services to you;
  • maintaining and developing our business systems; and
  • complying with our legal obligations.

Information may also be used for related secondary purposes, although we will endeavour to contact you for your express consent should the secondary purpose be one which we consider you may not reasonably expect.  Examples of related secondary purposes include:

  • insurance purposes;
  • tendering for legal services;
  • exchanging information with a subsidiary entity and our agencies;
  • quality assurance purposes.

Disclosure of your personal information

The people/organisations to which we disclose your information to may include:-

  • our staff members;
  • contractors and outsourced service providers who manage the services we provide to you;
  • your authorised representatives;
  • our professional advisers;
  • government and regulatory authorities as required or authorised by law; and
  • our related entities.

Please note that we do not sell or give client databases or mailing lists to any third parties.

Changes and access to your personal information

We are committed to keeping our records up-to-date and we encourage you to tell us when your details change.

You can request access to information from our Privacy Officer.  If we are unable to provide you with access, we will explain why. We reserve the right to charge a fee.

Security of your personal information

We are committed to protecting your personal information from misuse and loss, and from unauthorised access, modification and disclosure, and will take reasonable steps to do so.

Disposal and destruction of your personal information

If we no longer need or are no longer required to hold your information, we may destroy or permanently de-identify that information, without further notice to you.

Changes to this policy

From time to time, it may become necessary for us to review or amend this policy.  An up-to-date copy of this policy will be available in hard copy at all times at each of our offices and on our website, www.macdonnells.com.au.

Emails

We encourage email communication. Emails sent to or by us are routinely monitored by our information technology staff for systems administration, quality control and compliance purposes.

If you do not wish to communicate via email, please advise us.

TERMS OF ACCESS TO THE WEBSITE

This Website (referred to in these Terms of Access as the "Website") is owned and operated by MacDonnells Law ("MacDonnells") on the World Wide Web ("WWW").

The material on the Website is copyright (c) 2006 MacDonnells and/or other copyright owners.

The Website is available for you to access conditional on your acceptance without alteration of the terms and conditions set out below.  By continuing to access the Website you are agreeing to the terms and conditions set out below.

Use of material on the website including information made available by way of on-line subscription

A. Except for the limited use set out in para B you may not use the Website, or the material contained on it, for any purpose.  This involves:

 (a) the reproduction of the material in any material form;
 (b) the distribution of the material in any material form;
 (c) re-transmission of the material by any medium of communication;
 (d) uploading and/or reposting the material to any other site on the WWW;
 (e) "framing" the material on the Website with other material on any other WWW site.

The above are unlawful in any jurisdiction and are specifically prohibited by these Terms of Access.

B.  Notwithstanding the above restrictions on use of the material on the Website, you may download material from the Website for your personal non-commercial use provided you do not remove any copyright and trade mark notices contained on the material.

C. You may not modify or copy:
 (a) the layout of the Website; and
 (b) any computer software and code contained in the Website.

D. The Owner reserves all intellectual property rights, including, but not limited to, copyright in material and/or services provided by it.  The material provided on the Website is provided for personal use only and may not be:
 (a) re-sold and/or re-distributed in any material form;
 (b) stored in any storage media; and/or
 (c) re-transmitted in any media,
 without the prior written consent of the Owner.

Links to other websites

E. The Website contains links to sites on the WWW owned and operated by third parties and which are not under the control of the Owner.

F. In relation to the other sites on the WWW, which are linked to the Website, the Owner:
(a) provides the links to other sites as a convenience to you and the existence of a link to other sites does not imply any endorsement by the Owner of the linked site; and
 (b) is not responsible for the material contained on those linked sites.

Disclaimer

G. The Owner does not warrant guarantee or make any representation that:
(a) the Website, or the server that makes the site available on the WWW are free of software viruses;
(b) the functions contained in any software contained on the Website will operate uninterrupted or are error-free; and
 (c) errors and defects in the Website will be corrected.

H. The Owner is not liable to you for:
 (a) errors or omissions in the Website, or linked sites on the WWW;
 (b) delays to, interruptions of or cessation of the services provided in the
Website, or linked sites and;
(c) defamatory, offensive or illegal conduct of any user of the Website.
Whether caused through negligence of the Owner, its employees or independent contractors, or through any other cause.

I. You agree to accept the full cost of any necessary repair, correction and maintenance of any of your computer software or hardware, which may be necessary as a consequence of you accessing the Website.

J. The Owner and/or people authorised by it may gather and process the information:
 (a) which you may provide when accessing the Website, such as your name,

 (b) regarding the way in which you use the Website including, without
limitation, information acquired through the use of "cookies" programmed
during the accessing of the Website.

Termination of access

K. The Owner may terminate access to the Website at any time without giving any explanation or justification for the termination of access, and the Owner has no liability for any costs, losses or damages of any kind arising as a consequence of termination access to the Website.

Alteration of terms of access

L. The Owner reserves the right to change these Terms of Access:
 (a) with or without further notice to you; and
 (b) without giving you any explanation or justification for such change.

Relevant jurisdiction

M. If any part of these terms of access are found to be void, unlawful, or unenforceable then that part will be deemed to be severable from the balance of these terms of access and the severed part will not affect the validity and enforceability of any remaining provisions.

N. These terms of access will be governed by and interpreted in accordance with the law of the state of Queensland and the Commonwealth of Australia, without giving effect to any principles of conflicts of laws.

O. You agree to the jurisdiction of the courts of the State of Queensland and the Commonwealth of Australia to determine any dispute arising out of these terms of access.
